Leon
http://ca.news.yahoo.com/s/capress/100804/national/gold_mine_holdout Basically, his house is sitting on a huge goldmine and he was offered compensation for his home by the mining company (they offered up to $350K for his $14K home). He said no over and over and now a court has ordered vacation of the premises. The reclusive, thick-bearded man has said his fight wasn't about money, but about protecting property rights and the environment from a massive open-pit mine. Masse was the lone holdout from a relocation project that saw Osisko buy out 204 of 205 homeowners in his neighbourhood, which literally sits on top of the deposit. According to court documents, the family had been seeking $1 million from the mining company. He left the court prematurely, leading to the ruling. Fair or not? future_doc
Well, the Defendant was his own worst enemy by walking out of the Court and not making his argument. Court ruling have nothing to do with justice or fairness, this is a fact of life. Often, the best lawyer can win a case that might otherwise be unwinnable and the defandant certainly helped out the opposition. And he did not seem to have a lwyer, let alone a lawyer with experience in such matters who knows what he is doing. It seems that this is a moinig town and more than lkikely, the mining company had the minig rights under the land - so his case was unwinable from the gitgo. There is no mention that defendant actually owned the property, which I assume was not the case, his mother had a house on mining property. He was inexperienced and unfortuately, defendant wenrt out of his way to handle the case poorly. What did he expect? And with his disreepctful advisor shouting from the gallery interrupting proceedings. It like engaging teendoc to perform major surgery, the outcome is predictable.
