Two police officers have bee shot. He opened fire at road block. He stole vehicle in home invasion. Apparently police had received a tip. There is one million dollar reward. He is still not in custody. He is sealed off, cannot escape. CNN: Dorner is barricaded in cabin. One of the deputies is dead. SWAT Team entered cabin. On fire. No word on whereabouts of criminal. Apparently Dorner still remains at large. Police believe he remains in cabin. If so, he couldn't have survived. Story end - he is found dead. Edit: no body found as yet. Shot 4X, dragged her alive downstairs. Blade Runner bail hearing scheduled tomorrow. He likely will be given bail. This prediction is by legal experts. Judge seems unconvinced by defense arguments according to CNN reporter in courtroom. Sooner or later, the haters come. Now, there is a new one. Trolls will always be attracted here. Bail decision about to be made. The Magistrate ordered TV cameras removed. After reciting at length the law, the facts and numerous supporting affidavits, including evidence they were in love, that the relationship was on track, the reasons why police opposed bail, including he was a flight risk, that there are limited extradition treaties, after being exhaustive in its detail, including shots fired in downward direction, evidence accused threatened violence to another, after reviewing all the police evidence, including questionable evidence of hearing arguing, there were no signs of assault on the body of the deceased, that accused admitted shooting the deceased, after reviewing the history of bail, it is part of the Constitution, following the interests of justice, then considering checklist of pros and cons, and considering the public interest too, and case law for exceptional circumstances, where court must weigh the facts, Magistrate again reviewed the facts and went into if Section 6 offence, and listing arguments of both sides, Magistrate not concluding is premeditated murder, leaving it for judge to decide, there is only just circumstantial evidence, Chief Magistrate is taking a break, and we don't know bail decision. To be continued in few minutes. The Magistrate has just resumed again. Still impossible to know his leanings. He listed factors for his consideration, considering nature and gravity of charge, and weight of Crown case, he goes into errors, concessions of police witness. Important part of puzzle is missing. The police could have done more. He criticizes chief police witness and how he had handled the investigation. Police conceded witnesses of arguing had no idea where voices came from. He conceded decedant could have locked door if she heard accused shouting. Magistrate considers of prime importance that when crime of this magnitude, police have senior officer take control of crime scene with view to testifying in court. Although police witness has been tarnished, state case may still be strong. This is a circumstantial evidence case. Only the accused knows what happened. In considering state case, referring to case law, Magistrate recognizes he is handicapped not having all the evidence. He has difficulty in not ascertaining why accused entered into danger after hearing noise in bathroom and in many other facts not now known. The defense has failed in showing weakness of state case. However state cannot equally show its case is so strong accused will evade trial. He examines accused's ties to community. He discusses assets of the accused. Likely he would not want to make himself a fugitive. Issue is would he want to duck and dive all over the world as as an international fugitive. Magistrate does not believe this would happen. Accused has shown tendencies of aggression. But in this particular instance, Magistrate is critical of proof made by state. Investigating officer did not establish case. He has not shown predisposition to violence to attack the bail application. Magistrate then examines some relevant jurisprudence. (Here, it seems he favors bail:confused: ) In this particular matter, the grounds that need to be established regarding bail, the state needs to show where There would need to be evidence of shock and outrage by public if bail were granted, and state has not shown this. Fact that accused may own property in Italy Has not been shown. He is not a flight risk, no propensity To commit crime. Accused has offered under oath at this early stage, that reaching out in the affidavit, leads Magistrate to conclude that accused has made a case to be released on bail. This is Ruling!
